PUBLIC CONSULTATION ON PROPOSED AMENDED LOCAL LAWS
On 26 July 2022, Cook Shire Council (“Council”) resolved to propose amendments to the following Local Laws and Subordinate Local Laws (“Proposed Amended Local Laws”):
- Local Law No. 1 (Administration) 2016;
- Local Law No. 3 (Community and Environmental Management) 2016;
- Subordinate Local law No. 1 (Administration) 2016; and
- Subordinate Local law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2016.
The primary purposes of the Proposed Amended Local Laws are to:
(a) amend Local Law No. 1 (Administration) 2016 to:
(i) include camping on private property as a prescribed activity;
(ii) define the meaning of the term ‘prescribed camping activity’;
(iii) define the meaning of the term ‘urban area’; and
(iv) expand on Council’s ability to seize and impound a structure or other material left on local government controlled area or road;
(b) amend Subordinate Local Law No. 1 (Administration) 2016 to:
(i) include provisions to regulate camping on private property;
(ii) further define how approvals for temporary entertainment events are to be obtained;
(c) amend Local Law No. 3 (Community and Environmental Management) 2016 to remove outdated provisions in respect to declared local pests;
(d) amend Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2016 to:
(i) set out further prohibited activities for local government controlled areas or roads; and
(ii) set out further restricted activities for local government controlled areas or roads.
Council has identified that the Proposed Amended Local Laws may contain anti-competitive provisions, and Council has prepared a review of these anti-competitive provisions in accordance with legislative requirements.
Public Consultation
Council invites the public to provide written submissions on the Proposed Amended Local Laws. Written submissions may be provided to Council in writing and may be delivered to Council:
(a) by email to mail@cook.qld.gov.au ; or
(b) by post to PO Box 3, Cooktown, QLD, 4895; or
(c) by hand-delivery to Council’s office at 10 Furneaux Street, Cooktown, QLD, 4895.
Written submissions may only be considered if they are received by Council before 5.00pm, 2 September 2022. Submissions received after this time and date may not be considered by Council.
