The development triggered a referral under Schedule 10, Part 9, Division 4, Subdivision 1, Table 1 of the Planning Regulation 2017. The application was properly referred to the Department of State Development, Infrastructure, Local Government and Planning (via the State Assessment Referral Agency (SARA)), and was subsequently approved on 22 January 2021.

All aspects of the State Planning Policy have been adequately reflected in the Cook Shire Council Planning Scheme 2017. Therefore assessment against the applicable Planning Scheme provisions will address any relevant State issues.


No submissions were received during the public notification period of this application.


Cook Shire Council approved in full with conditions the application as it complied with the applicable assessment benchmarks. In particular:

(a)    An assessment was made against the applicable assessment benchmarks and the proposed development demonstrated compliance.

(b)   The development involves the utilisation of an area that has been cleared of vegetation, therefore it is a better use of the land.

(c)    The development services a local need for the Port Stewart community.

(d)   The proposed development will have no detrimental impact on the property, surrounding properties, or the environment itself.

The State Assessment Referral Agency (SARA) was a referral agency for the application and approved in full the application. The reasons for their decision are:

  • The proposed development will not generate significant traffic.
  • The proposed development will not impact the safety and infrastructure condition of the Peninsula Development Road (PDR), nor will it create a worsening of road transport infrastructure.
  • The proposed development is unlikely to impact the PDR or on state transport infrastructure.

It is important that the smaller townships of Cook Shire have uses that service a local need and contribute to the operations of the community. The proposed development will support the surrounding residents in the Port Stewart locality by providing critical air access and evacuation throughout the year, specifically during the wet season.
