On 30 May 2024 Council resolved to propose amendments to three subordinate local laws. Submissions are now being sought on these proposed changes.

PUBLIC CONSULTATION ON PROPOSED AMENDED LOCAL LAWS
On 30 May 2024, Cook Shire Council (“Council”) resolved to propose amendments to the following Subordinate Local Laws (“Proposed Amended Local Laws”):
- Subordinate Local Law No. 1 (Administration) 2016; and
- Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2016; and
- Subordinate Local Law No. 5 (Parking) 2016.
The primary purposes of the Proposed Amended Local Laws are to:
Amend Subordinate Local Law No. 1 (Administration) 2016 to:
- modify the criteria and specify an additional condition that may be imposed on approvals for the commercial use of local government controlled areas and roads; and
- expand on the statutory framework to apply, assess and approve parking contrary to official traffic signs by including additional categories of parking permits; and
- provide a definition for a commercial vehicle for the purposes of assessing and approving a commercial vehicle identification label;
Amend Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2016 to:
- modify the definition of both designated camping areas and recreational vehicle (RV) rest areas for consistency and to remove the requirement for Council to keep a register; and
- clarify the definition of a recreational vehicle (RV) to ensure ablution and cooking facilities are permanently affixed within the vehicle;
Amend Subordinate Local Law No. 5 (Parking) 2016 to:
- remove the Cooktown Racecourse RV parking area from being a declared off-street regulated parking area; and
- declare the Webber Esplanade (Lease C) Carpark as a regulated off-street parking area; and
- declare the Webber Esplanade Carpark as a regulated off-street parking area; and
- introduce new categories of parking permits and prescribe criteria for persons eligible to apply for those parking permits.
Council has identified that the Proposed Amended Local Laws may contain anti-competitive provisions, and Council has prepared a review of these anti-competitive provisions in accordance with legislative requirements.
Public Consultation
Council invites the public to provide written submissions on the Proposed Amended Local Laws. Written submissions may be provided to Council in writing and may be delivered to Council:
(a) by email to mail@cook.qld.gov.au ; or
(b) by post to PO Box 3, Cooktown, QLD, 4895; or
(c) by hand-delivery to Council’s office at 10 Furneaux Street, Cooktown, QLD, 4895.
Written submissions may only be considered if they are received by Council before 5.00pm, 28 June 2024. Submissions received after this time and date may not be considered by Council.
