On 27 August 2024 Cook Shire Council adopted amendments to Subordinate Local Law No. 1 (Administration) 2016, Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2016 and Subordinate Local Law No. 5 (Parking) 2016. More information on these amendments can be found below.

Making of Local Laws
- Cook Shire Council (“the Council”) has, by resolution dated 27 August 2024, made:
(a) Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2024.
Commencement
- This notice commences on 27 August 2024.
Purpose and General Effect
- The purpose and general effect of Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2024 is to:
(a) amend Subordinate Local Law No. 1 (Administration) 2016 to:
(i) modify the criteria and specify an additional condition that may be imposed on approvals for the commercial use of local government controlled areas and roads; and
(ii) expand on the statutory framework to apply, assess and approve parking contrary to official traffic signs by including additional categories of parking permits; and
(iii) provide a definition for a commercial vehicle for the purposes of assessing and approving a commercial vehicle identification label;
(b) amend Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2016 to:
(i) modify the definition of both designated camping areas and recreational vehicle (RV) rest areas for consistency and to remove the requirement for Council to keep a register; and
(ii) clarify the definition of a recreational vehicle (RV) to ensure ablution and cooking facilities are permanently affixed within the vehicle;
(c) amend Subordinate Local Law No. 5 (Parking) 2016 to:
(i) remove the Cooktown Racecourse RV parking area from being a declared off-street regulated parking area; and
(ii) declare the Webber Esplanade (Lease C) Carpark as a regulated off-street parking area; and
(iii) declare the Webber Esplanade Carpark as a regulated off-street parking area; and
(iv) introduce new categories of parking permits and prescribe criteria for persons eligible to apply for those parking permits.
- In the case of Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2024, the Local Laws that authorise the Subordinate Local Laws that are being amended are:
(a) Local Law No. 1 (Administration) 2016;
(b) Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2016; and
(c) Local Law No. 5 (Parking) 2016
for each of the corresponding Subordinate Local Laws.

- Copies of the Amending Local Laws, and the consolidated versions of the Local Laws that have been amended, may be:
(a) inspected and purchased at the local government’s public office at 10 Furneaux Street, Cooktown, Qld, 4895, and are available for download from Council’s website; and
(b) viewed by the public on the Department of Local Government, Racing and Multicultural Affairs’ website.
